SpinPilot Terms of Service

Last Updated: August 12, 2026 Effective Date: August 12, 2026

Welcome to SpinPilot ("SpinPilot," "we," "us," or "our"). These Terms of Service (these "Terms") govern your access to and use of the SpinPilot mobile application, website, and related services (collectively, the "Service"). The Service is a cycling computer application that provides GPS tracking, ride recording, telemetry from connected sensors, route planning, and optional third-party synchronization.

By creating an account, downloading, installing, accessing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility and Account

1.1 Age Requirement

You must be at least 13 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. Users in the European Economic Area, the United Kingdom, and other applicable regions must be at least 16 years old to create an account without parental consent. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

1.2 Account Registration

To access most features of the Service, you must create an account using a valid email address and password, or through a supported third-party sign-in provider (Google or Apple). You agree to:

  • Provide accurate, current, and complete information ("Registration Data").
  • Maintain the security and confidentiality of your account credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use or security breach.
  • Be responsible for all content and data uploaded through your account.

We reserve the right to suspend or terminate accounts that provide false, inaccurate, or misleading information.

1.3 One Person, One Account

Each account is intended for an individual user. You may not create an account for someone else, share your account credentials, or transfer your account to another person without our prior written consent.

2. Description of Service

SpinPilot is a production-grade cycling computer application. The Service includes, but is not limited to:

  • GPS ride recording using your device's location services, including a battery-optimized foreground service.
  • Sensor integration via Bluetooth Low Energy (BLE) with heart-rate monitors, power meters, cadence sensors, and other compatible cycling devices.
  • Offline map support using cached and bundled vector/raster map tiles.
  • Route planning and navigation, including turn-by-turn directions and route discovery.
  • Ride analytics, including power estimation, elevation, speed, cadence, and heart-rate metrics.
  • Cloud sync of your rides to your SpinPilot account (via Supabase) and, if you connect it, to Strava.
  • Activity sharing, including the ability to generate shareable activity summary cards.
  • Audio feedback via text-to-speech during rides.

We may add, modify, or discontinue features at any time without prior notice.

3. Acceptable Use

You agree not to:

  1. Use the Service for any unlawful purpose or in violation of any local, state, national, or international law.
  2. Record rides while operating a motor vehicle in a manner that misrepresents the activity.
  3. Upload, store, or transmit content that infringes the intellectual property, privacy, or other rights of any third party.
  4. Interfere with, disrupt, or overload the Service, its servers, or the underlying infrastructure of Supabase, Strava, Google, Apple, or any map data provider.
  5. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except to the extent permitted by applicable law.
  6. Use automated systems (bots, scrapers, crawlers) to access the Service, except through officially supported APIs if we provide them.
  7. Circumvent any rate limits, security measures, or authentication mechanisms.
  8. Sell, resell, rent, or lease the Service or any portion of it without our written consent.
  9. Use the Service in any manner that could damage, disable, or impair the real-world safety of yourself or others (for example, by attempting to configure the app while riding).

3.1 Safety Warning

Cycling carries inherent risks. SpinPilot is a tool to record and analyze your rides, not a guarantee of safety. Always obey local traffic laws, ride within your ability, wear appropriate safety equipment, and keep your eyes on the road. Do not interact with the app while riding in traffic. Configure routes, sensors, and settings before you start moving. We are not liable for any injury, accident, or damage that occurs while you use or attempt to use the Service.

4. User Content and Data

4.1 Your Data

You retain ownership of all ride data, routes, profile information, and other content you submit, upload, or generate through the Service ("User Content"). This includes your GPS trails, telemetry, and activity summaries.

4.2 License to SpinPilot

By submitting User Content, you grant SpinPilot a worldwide, non-exclusive, royalty-free, sub-licensable license to host, store, process, transmit, and display your User Content solely for the purpose of operating, providing, and improving the Service for you. This includes syncing your rides to your connected Strava account when you request it.

We do not sell your ride data to third parties. See our Privacy Policy for details on how data is handled.

4.3 Storage and Sync

  • Your rides are stored locally on your device in an encrypted SQLite database and, when you are signed in, synced to your cloud account.
  • When you connect Strava, your rides are uploaded to your own Strava account. We store only non-secret connection metadata in our cloud; your Strava access and refresh tokens are stored on your device only using platform secure storage.
  • Cloud sync requires network connectivity. If you are offline, rides are queued locally and synced automatically when connectivity returns.
  • Data Loss Disclaimer: We are not responsible for data loss caused by device failure, OS upgrades, app uninstallation, or network unavailability. You are encouraged to enable cloud sync to preserve your ride history.

4.4 Data Retention

  • Locally stored rides persist until you delete them.
  • Cloud-synced rides persist in your account until you delete them through the Service or terminate your account.
  • Deleting a ride locally does not remove it from Strava after it has been uploaded. You must manage your Strava data directly through Strava.

4.5 Responsibility for Content

You are solely responsible for your User Content and any consequences of sharing it. You represent that you have all necessary rights to submit and share your User Content.

5. Third-Party Services

The Service integrates with and relies on third-party services, each governed by their own terms:

| Service | Purpose | Link | |---|---|---| | Supabase | User authentication and cloud data storage | supabase.com | | Strava | Optional ride upload to your Strava account | strava.com/legal/terms | | Google Sign-In | Authentication via Google account | Google Terms | | Sign in with Apple | Authentication via Apple ID | Apple Media Services Terms | | Map data providers (e.g., OpenStreetMap, Thunderforest) | Offline and online map tiles | OSM Terms, Thunderforest | | Overpass / OpenStreetMap | Route and POI discovery | OSM Terms |

5.1 Third-Party Rules Apply

When you connect Strava, Google, or Apple, your use of those services remains subject to their respective Terms of Service and acceptable-use policies. We are not responsible for their actions, outages, or changes.

5.2 No Warranty for Third-Party Accuracy

Map data, route suggestions, elevation, and POI information sourced from third parties may be incomplete or inaccurate. Do not rely solely on the Service for navigation in unfamiliar or hazardous terrain. Always carry an alternative navigation method.

6. Subscriptions, Payments, and Fees

6.1 Current Pricing

SpinPilot may currently be offered free of charge. We reserve the right to introduce paid features, subscriptions, or one-time purchases in the future. Any paid features will be clearly disclosed before you are charged, and any subscription will be governed by the pricing terms presented at the time of purchase.

6.2 In-App Subscriptions

If you purchase an auto-renewing subscription through Apple's App Store or Google Play:

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
  • Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel subscriptions through your device's app store settings.
  • Refunds are governed by the respective app store's refund policy.

6.3 No Refunds Outside Store Policy

We do not issue refunds directly. All refund requests must be handled through Apple's App Store or Google Play according to their policies.

7. Intellectual Property

7.1 SpinPilot Ownership

The Service, including its software, design, logos, text, graphics, and underlying code, is owned by SpinPilot and protected by international intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

7.2 Open-Source Components

SpinPilot is built using open-source software, including the Flutter framework and numerous packages. Applicable open-source license terms continue to apply to those components.

7.3 Trademarks

"SpinPilot," the SpinPilot logo, and related marks are trademarks of SpinPilot. All other trademarks are the property of their respective owners.

7.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use them without restriction or compensation to you.

8. Disclaimers

8.1 "As-Is" Service

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. To the fullest extent permitted by law, SpinPilot and its suppliers disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

8.2 No Warranty of Accuracy

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • GPS, telemetry, power, elevation, or heart-rate data will be accurate or reliable — these depend on your device hardware, sensor calibration, GPS signal, and environmental conditions.
  • Map tiles, route suggestions, or navigation will be complete or safe.
  • The Service will function on your specific device or OS version.

8.3 Battery and Background Use

SpinPilot uses a foreground service to record rides while your screen is off or another app is open. This is by design and will consume battery. You are responsible for ensuring your device has adequate battery and is not overheating during long rides.

8.4 Medical Disclaimer

Heart-rate and other biometric data provided by the Service is for fitness informational purposes only and is not medical advice. It is not a substitute for professional medical evaluation. Consult a physician before beginning or modifying any exercise program, especially if you have a heart condition or other health concern.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SpinPilot, its affiliates, officers, directors, employees, or suppliers be liable for:

  1. Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or rides.
  2. Any personal injury, accident, death, or property damage arising from your use of the Service while cycling or otherwise.
  3. Loss of or damage to locally stored rides due to device failure, app uninstall, OS upgrade, or any other cause.
  4. Any failure of Strava, Supabase, Google, Apple, or map providers to function correctly.
  5. Any unauthorized access to your account or data due to your failure to safeguard credentials.

The total aggregate liability of SpinPilot for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have paid to us in the past 12 months, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless SpinPilot and its affiliates, officers, directors, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your User Content or your violation of these Terms.
  • Your misuse of the Service, including unsafe use while cycling.
  • Your violation of any law or third-party right, including intellectual property rights.

We reserve the right, at our own expense, to assume the exclusive defense of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.

11. Account Termination

11.1 By You

You may delete your account at any time through the Service's settings. Account deletion will:

  • Remove your profile and cloud-synced data from our systems (subject to our Privacy Policy retention notes).
  • Not automatically remove rides already uploaded to Strava.
  • Not remove rides stored locally on your device — those persist in your device's database until you delete them or uninstall the app.

11.2 By Us

We may suspend or terminate your access to the Service at any time, without notice, for any reason, including:

  • Violation of these Terms.
  • Fraudulent, abusive, or unlawful activity.
  • Extended inactivity.
  • Discontinuation of the Service or any feature.

11.3 Survival

Upon termination, all licenses granted to you cease immediately. Sections that by their nature should survive (including Ownership, Disclaimers, Limitation of Liability, and Governing Law) will remain in effect.

12. Modifications to These Terms

We may revise these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. We will notify you of material changes through:

  • An in-app notice,
  • An email to the address associated with your account, or
  • A prominent notice within the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and may delete your account.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms and any dispute arising out of or related to them shall be governed by the laws of the jurisdiction in which SpinPilot's operating entity is established, without regard to conflict-of-laws principles. (Replace this placeholder with your specific jurisdiction — e.g., "the State of Delaware, USA" or "England and Wales" — before publishing.)

13.2 Informal Resolution First

Before filing a claim, you agree to contact us in good faith to resolve the dispute informally. Most disputes can be resolved through direct communication.

13.3 Binding Arbitration

Any dispute not resolved informally will be resolved through binding individual arbitration, except that you may bring claims in small claims court if they qualify. You waive the right to participate in a class action lawsuit or class-wide arbitration.

13.4 EU/UK Consumer Rights

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits any legal rights you may have under those laws.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SpinPilot regarding the Service.

14.2 Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our consent. We may assign these Terms without restriction.

14.5 Force Majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemic, labor disputes, or internet/telecommunications failures.
